It is set in advance. • agency workers – an employer pays worker’s remuneration to the agency. The agency is responsible for working time. You also have the same rights as your permanent colleagues to use any shared facilities and services provided by your employer. After 12 weeks in the job you qualify for the same rights as someone employed directly. This is known as ‘equal treatment’. So you are entitled to equal pay, automatic pension enrolment and paid annual leave. • Freelancers, consultants and contractors – they are self-employed or are part of other companies, they might not be entitled to the same rights as workers, employer is responsible for their health and safety • zero hour contract – this contracts becoming increasingly commonplace in UK. Employer doesn’t have to provide you with work. Instead, work is provided on an “as required” basis. You only receive paid for hours actually worked. • employing family – if an employer hire family member he must: - avoid special treatment in terms of pay and working conditions, - pay tax and National Insurance contributions, - follow working time regulations if he hire younger family members, - has employer’s liability insurance to cover young family member, - check if he need to provide them with a workplace pension scheme (https://www.gov.uk/workplace-pensions-employers). • Volunteers and voluntary staff – if an employer takes them he is responsible for their health and safety and he must give them inductions and training • Employing young people - the youngest age a child can work part-time is 13. There are special rules about their working time and jobs they are allowed to do (https://www.gov.uk/child-employment). Young people are entitled to special rights like: - statutory maternity pay and ordinary statutory paternity pay if they qualify as a result of their continuous employment - paid time off for study and training - redundancy pay.

Contracts A contract of employment is an agreement between employer and employee. There is no specific type of contract recommended by the government but its terms must comply with employment law. All of employees are entitled to a contract of employment. According to the Employment Rights Act 1996 it should be written statement of the main terms of the contract. It should be provided by employer within two calendar months of starting work. The following details must be included in the written statement: • employer’s and employee’s names • job title or job description • date the employment began, place of work and address of employer • amount of pay and frequency of payments • hours of work, holiday pay and sick pay entitlements • pension arrangements • notice period • end date for fixed term contracts • how long a temporary job is expected to last • collective agreements • grievance and appeal arrangements • how to complain about a disciplinary or dismissal decision. You have to be sure that you understand your employment contract. You and employer should both sign the contract and keep a signed copy – it may be used as evidence if there is a dispute. The overall aim in view was to advance the process of Europeanisation of private law. As explained in the Foreword, the Study Group has striven to draw up "sound and fitting" principles with a view to developing proposals and concepts for the further development of private law in Europe. The long term objective of this study in comparative law, we gather, is to achieve what might be called further and better understanding of the possible feasibility of harmonizing European law in the area of -- in this case -- mandate contracts. Whether such harmonization is desirable or not is not for the researchers to decide, say the editors. Rather, it is a matter for political decision making. But the fact that this research has been undertaken and has now been made available means that, for the most part, such decision making in the future will almost certainly be more plausible and informed. What the project has sought to do is to identify areas of common ground within European legal systems -- or -- to adopt a majority position in areas where common ground is missing. The contributors to this project -- which is truly vast -- hail from literally dozens of top universities and research institutions Europe-wide, from Scandinavia to eastern, southern and of course, western Europe, including the UK which has contributed research form, for example, Oxford, Edinburgh and Sheffield Universities. The research is grouped into some seven chapters which cover such areas as the scope and definition of the mandate contract... the obligations of the principal... performance by the agent... issues regarding changes and conflicts of interest... and grounds for termination. 'National Notes' which compare rules and principles across a wide range of European countries are interspersed throughout. As you would expect, the book is an excellent source of research material, including an extensive table of cases and numerous reading lists. Published by the Oxford University Press, this is a distinguished work of scholarly legal research which aims for complete objectivity and political neutrality. Once you have completed your chosen TEFL course and have that all important certificate in your hand, you can seriously start to plan the next stage of your adventure. Thanks to the sustained demand for English language teachers right across the world there are plenty of countries to choose from, each with its own unique set of attractions. But how long will you have to commit for when you sign the job contract? Europe The most common contract in European schools is for an academic year that generally runs from September to June. The great thing here is you will have a couple of months off during the summer break to travel or earn some extra cash working with private students or at a summer camp. Summer language camps are very popular across much of Europe and usually run for 4 to 8 weeks, providing a great opportunity for short term work. Three and six month contracts can also be found in some countries but these are less common than the usual full year contract. If you are keen on a short term deal you will need to do plenty of research to locate them. Asia Once again the most common contracts are for one year; this could either be a full twelve months or for an academic year. The academic year does vary considerably depending on the country and type of school so this could begin in January, May or September. One of the great things about the huge job market in Asia is that you have the option of organizing a job to go to before you leave your home country. China, South Korea, Japan and Taiwan are the most common destinations for these pre-arranged jobs. Short term contracts are also available in smaller numbers across the region but you will probably need to be in the country to have a good chance of securing them. Latin America Similar to Asia, most countries in this region prefer to offer one year contracts that either cover the school year or a full twelve months. Once again, the start of the school year does vary from school to school so you will need to do some research before you make any firm plans. Some less developed countries in the region also offer short term contracts and volunteer based work, which may be a good option for those looking for adventure and to get off the beaten path. The Middle East Countries such as the United Arab Emirates, Saudi Arabia, Oman and Qatar offer some of the most attractive contracts to be found anywhere in the industry. Paid airfares, free housing, paid holidays and a tax free salary are just some of the benefits available, although you will probably need to sign for 12 months or even two years to land the most lucrative positions.
